Welcome to Taglab UK ("we," "our," or "us"). These Terms of Use ("Terms") govern your access to and use of our mobile application and services (collectively, the "Service") that enables you to create pet profiles for NFC tags.

By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of these Terms, you may not access the Service.

2. Description of Service

Taglab UK provides a platform that allows users to:

  • Create digital profiles for their pets
  • Write profile URLs to NFC tags using our proprietary tags and chips
  • Share pet information through secure URLs
  • Manage multiple pet profiles through subscription tiers
  • Receive notifications when pet profiles are accessed

3. Eligibility and Account Registration

3.1 Age Requirements

Our Service is available to users of all ages. However, users under 18 must have parental or guardian supervision and consent to use the Service.

3.2 Account Registration

To use certain features, you must create an account by providing:

  • A valid name
  • A valid email address
  • Optional contact information (phone number, address)

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.3 Accuracy of Information

You agree to provide accurate, current, and complete information and to update such information to keep it accurate, current, and complete.

4. Subscription Plans and Pricing

4.1 Free Tier

  • Up to 2 pet profiles
  • Email notifications
  • Basic profile features

4.2 Paid Subscription (Monthly/Annual)

  • Unlimited pet profiles
  • Push notifications
  • Enhanced profile information options
  • Additional premium features

4.3 Billing and Payment

  • Payments are processed through RevenueCat for Apple and Android platforms
  • Subscriptions automatically renew unless cancelled
  • Prices are subject to change with reasonable notice
  • All fees are non-refundable except as described in Section 5

5. Refund and Cancellation Policy

5.1 Refunds

  • General Policy: No refunds are provided after a third profile is created
  • Individual Cases: Refunds may be considered on a case-by-case basis at our sole discretion
  • Cancellation: You may cancel your subscription at any time through your device's app store settings

5.2 Effect of Cancellation

Upon cancellation, you will retain access to paid features until the end of your current billing period, after which your account will revert to the free tier.

6. User Content and Conduct

6.1 Your Content

You retain ownership of all content you submit to the Service, including pet profiles, photos, and other information ("User Content"). By submitting User Content, you grant us a license to use, store, and display such content as necessary to provide the Service.

6.2 Content Standards

You agree that your User Content will not:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Contain false, misleading, or fraudulent information
  • Include harmful, offensive, or inappropriate material
  • Contain malware, viruses, or other harmful code

6.3 Privacy and Sharing

  • You control what information to include in pet profiles
  • You may enable "Privacy Mode" to limit visible information
  • Pet profiles are accessible only through secure URLs you choose to share
  • You are responsible for managing who has access to your pet profile URLs

7. NFC Tags and Hardware

7.1 NFC Tag Products

  • We manufacture NFC tags using pre-made NFC chips
  • Tags are designed to work with our Service and mobile devices with NFC capability
  • Performance may vary based on device compatibility and environmental factors

7.2 Tag Limitations

  • NFC functionality requires compatible devices
  • Tags may have limited read range and durability
  • We do not guarantee tag performance in all conditions or environments

7.3 Replacement and Warranty

Tag warranty and replacement policies will be specified at the time of purchase.

8. Prohibited Uses

You may not use the Service to:

  • Violate any applicable laws or regulations
  • Impersonate others or provide false information
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to the Service
  • Use the Service for commercial purposes without authorization
  • Create profiles for animals you do not own without permission
  • Share harmful, illegal, or inappropriate content

9. Intellectual Property Rights

9.1 Our Rights

The Service, including all content, features, and functionality, is owned by Taglab UK and is protected by copyright, trademark, and other intellectual property laws.

9.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.

9.3 Restrictions

You may not:

  • Copy, modify, or distribute our content
  • Reverse engineer or attempt to extract source code
  • Use our trademarks without permission
  • Remove or modify any proprietary notices

10. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. By using the Service, you agree to our data practices as described in the Privacy Policy.

11. Service Availability and Modifications

11.1 Availability

We strive to maintain Service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or technical issues.

11.2 Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time. We will provide reasonable notice of material changes when possible.

12. Disclaimers and Limitation of Liability

12.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

12.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAGLAB UK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

12.3 Maximum Liability

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless Taglab UK and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your User Content
  • Your violation of any third-party rights

14. Termination

14.1 Termination by You

You may terminate your account at any time by contacting us or through the app settings.

14.2 Termination by Us

We may terminate or suspend your account immediately if you violate these Terms or for other reasons at our sole discretion.

14.3 Effect of Termination

Upon termination, your access to the Service will cease, and we may delete your User Content, subject to applicable law and our Privacy Policy.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

15.2 Jurisdiction

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15.3 Limitation Period

Any claim or cause of action arising out of these Terms must be filed within one (1) year after such claim or cause of action arose, or it will be forever barred.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Taglab UK regarding the Service.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

16.5 Updates to Terms

We may update these Terms from time to time. We will notify you of material changes by:

  • Posting updated Terms in the app
  • Sending you a notification
  • Updating the "Last Updated" date

Continued use of the Service after changes constitutes acceptance of the updated Terms.

>Pet Identification: TagLab products are designed for style, fun, and accessory use. We take no responsibility for ensuring your pet has the correct identification. Tags worn as the only form of identification are done so at the owner’s discretion, and owners are responsible for ensuring their pet is properly identified in accordance with local laws.

>Product Quality: All TagLab items are handmade and 3D printed, meaning each piece is unique. While we carefully inspect all items, small variations, minor imperfections, or differences in colour may occur. Colours may also appear different on screen compared to the finished product due to printing and display variations.

>Durability: TagLab tags are durable, waterproof, and lightweight, but they are not chew-proof. Hardware may tarnish over time, with black coated hardware potentially tarnishing faster than standard metal. Tags are not dishwasher or washing machine safe, flammable when exposed to flame, and should not be exposed to temperatures over 40°C. Tags are worn at the owner’s own risk, and TagLab accepts no liability for damage or injury resulting from use.

>Tag Customisation: All personalised and custom tags are made to order. We cannot accept returns or exchanges, so please ensure all customisation details are correct before ordering. Any phone number added to the back of a tag will be visible to anyone who handles the tag. For custom designs created by TagLab, we retain ownership of the design and reserve the right to resell or reproduce it.

>Copyright & Intellectual Property: All TagLab designs, artwork, and branding are owned by TagLab. Copying, reproducing, or selling TagLab designs without permission is strictly prohibited.

>NFC Tags: NFC tags require a compatible smartphone to access stored information. Not all phones are NFC-enabled, and internet access may be required to view certain content. Information stored on the tag can be seen by anyone with a compatible device. TagLab is not affiliated with any third-party apps or platforms used to store or display information.

>Privacy: Information provided during checkout is secure and is used solely for the purpose of creating your custom tag. This is a standard purchase of a customisable product, and by placing an order, the customer acknowledges that their personal information will be stored and used only to fulfil the order.

>General Use & Liability: By purchasing and using TagLab products, you agree that you are responsible for your pet and the use of the tags. TagLab accepts no liability for injury, loss, or damage arising from use, including damage to property, pets, or third parties.
